Registered at the Crossroads Bank for Enterprises with number BE0786.212.417. When using our website or web applications BOMONTI BV will be processing your personal information (Personal data). The lawfulness of the process, the security and confidentiality of personal data is essential to us. Therefore we will treat your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and the council of 27 April 2016 on the protection of natural persons with regards to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the General Data Protection Regulation (“GDPR”)) and the Act of 8 December 1992 for the protection of privacy with regard to the processing of personal data (“Privacy Act”).

Processing of data

The term “personal data” includes all information about an identified or identifiable natural person, agreements concluded by you and other documents that allow to identify you and information such as your:

The term “processing” implicates every possible action that can be taken with regards to your personal data, from collection to communication to destruction. We are responsible for the processing of your personal data, unless we carry out processing on behalf of our customers. In the latter case, our customer is responsible for the processing of your personal data.

Collection and processing of your personal data:

The decision of sharing your personal data with us is completely yours to make. Please note that if you do not provide us with your details the placing of an order, answering your questions, completing an agreement and the delivery of our services may be refused. We do not collect personal data on the basis of which you can be directly identified, unless you provide us with this data directly. This would be the case for example by filling in the contact form on our website or when you contact us directly by e-mail or phone call. We solely collect personal data from which you cannot be directly identified, such as the type of browser you use, your IP-address, etc. in an automated manner, as described in our Cookie policy. You are solely responsible for the accuracy of the data you provide us and enter on our website.

Personal data processing on behalf of our customers

Certain personal data will also be processed by us on behalf of our customers. Concerning the personal data that they process by using our web application (cloud based) or other cloud or hosting services.

These processing operations take place on the basis of an agreement that we have concluded with our customer. If we process these personal data on behalf of our customers than our customer guarantees the correct collection and processing of the personal data. Therefore we do not guarantee the lawfulness of processing operations by our customers that are not part of our assignment.

Processed data: purpose

The processing of personal data for which we are responsible in the first place; In the context of fulfilling our contractual obligations we process your personal data. Your personal data will be processed for following purposes:

- Delivery and invoicing of the services (and therefore goods) we offer on our website

- Taking measures concerning the verification of your (personal) data when registering and

the protection of your (personal) data

- The management of our customer administration as well as the technical parts of the administration of our website or web applications.

In addition, we process your personal data when necessary for the defence of our legitimate interests or those of a third party for following purposes:

We will always contact you, by e-mail or phone call, if we intend to process your personal data for any other purpose than mentioned in this privacy statement. For this type of information we will be using your e-mail address or phone number you have provided us.

Confidential

All personal data is kept strictly confidential and is under no circumstances passed on to third parties, unless we have obtained explicit permission prior to this or if the data is communicated to our external technical service providers/ sub-processors to facilitate the delivery of our end products or services.

Withdraw permission

Withdrawing the permission you have given us is always possible by sending a written or electronic request to us adding a copy of your identity card.

Withdrawal of your consent is not possible for processing that takes place on the basis of an agreement or processing that is necessary for the representation of our legitimate interests or those of a third party. On these processing operations the revocation has therefore no influence.

Adding that the withdrawal of your consent has no influence on the lawfulness of the processing operations that were already carried out on the basis of your consent before the withdrawal.

Duration

The period for how long your personal data will be stored depends on the achievement of the purposes of the processing and the fulfilment of our contractual obligations. After you are no longer a customer your personal data will be stored for a minimum of 5 years. The data used by us for the response of the questions and/or comments submitted via the forms on our website or after receiving an e-mail will be stored for a maximum of one year after the message has been sent.

Rights


Rights of access:

You have the right to request access to your personal data, the correction of incorrect or incomplete personal data or the deletion of your personal data. The erasure of personal data is not possible if the process of your data is necessary for the performance or conclusion of an agreement or fpr the substantiation or defence in the context of a legal claim.

Restriction of the processing process:


You have the right to obtain the restriction of the processing in certain cases, such as the following:

-  When disputing the accuracy of your personal data

-  When the processing is unlawful and you oppose the erasure of the personal data

-  When you need the personal data for the setting, exercise or substantiation of a legal claim

-  When we no longer need your personal data for our processing purposes

You have the right to obtain/ transfer the personal data, related to you and that you have provided us. This type of transfer or acquisition is not possible if the processing of your personal data is necessary for the conclusion/ performance of an agreement, as well as the defence or substantiation of a legal claim.

Automated decision-making:

You have the right not to be subjected to a decision based solely on automated processing if this has any legal consequences for you or if it significantly affects you. If this decision is necessary for the conclusion or execution of an agreement than this is not possible.

Objection:

You have the right to object to the processing of your data which is necessary for our legitimate interests and for direct marketing purposes. An objection is nor possible if the processing of your personal data is necessary for the execution of an agreement.

Exercising rights:

You can exercise these rights by sending us a dated written or an electronic request with a copy of your identity card. If necessary you can provide us with an additional statement. We will notify you in writing if we believe you are not entitled to exercise one or more of these rights. The exercise of any of these rights against us shall not exclude the exercise of the right towards our customers, or vice versa. You must address your request to the concerning if you would want to exercise one of these rights with regards to our customer.

We are not responsible for the content of third party websites referred to on our website, nor for the products or services mentioned on these websites. Adding that only this privacy statement applies to the use of our website. We advise you to read the privacy policy on each website you visit since the privacy statements on other websites may differ from ours.

Complaints

You have the right to file a complaint with the Data Protection Authority if you believe that the processing of your personal data by us violates the provision of this privacy statement or the GDPR.

Future adjustments

There is always a possibility that these privacy statement will be expanded or adjusted in the future. This would be the case for example if new developments would occur concerning the above mentioned legal rights or obligations. Therefor we recommend a regular consultation of this privacy statement.
